Tomi Rae Hynie and Brown''s family have been feuding since his death on Christmas Day at the age of 73.
Lawyers for Brown say his will does not include Ms Hynie and the five-year-old child she had with him, but did provide for his other six children.
Ms Hynie says she was married to Brown, but his family have been disputing the legality of her claim.
Ms Hynie was already married at the time of her wedding to Brown, making their marriage void. Her previous marriage was annulled but she and Brown never held another ceremony.
Locked out
The 36-year-old, who was a backing singer for Brown, said she was locked out of his house on the day of his death.
Buddy Dallas, who is part of Brown''s legal team, said the house is owned by a trust and has been since 2000.
"It was not in the name of James Brown and hasn''t been that way for years," Mr Dallas said.
Meanwhile, the embalmed body of the star has still not been buried, Ms Hynie''s lawyer, Thornton Morris, told BBC 1Xtra''s TX.
He said it was because Brown''s family were refusing to include her in their plans.
"She''s not even able to participate in the burial of her husband," he said.
Several memorial services were held for the singer, who died of pneumonia, with both fans and celebrities paying final tributes to the soul legend, who was best known for hits such as I Got You (I Feel Good) and Living in America.
